Notice on Strengthening Relevant Work of Printing and Reproduction Enterprises
Lead-in: Notice of the Beijing Municipal Bureau of Press, Publication, Radio, Film and Television on Further Strengthening the Internal Management of Printing, Reproduction and Distribution Enterprises and Improving the Level of Lawful Operation
To all printing, reproduction and distribution enterprises in the Beijing area:
In order to welcome the 65th anniversary of the founding of the People's Republic of China and the informal APEC leaders' meeting to be held in Beijing in November, the printing, reproduction and distribution industry in the Beijing area should strive to maintain a healthy, orderly and safe production and operation situation and contribute to creating a favorable cultural atmosphere in the capital. At present, the overall situation of lawful and standardized operation of printing, reproduction and distribution enterprises is good. However, for some time, cases have occasionally occurred in which individual enterprises failed to strictly abide by industry regulations, operated in violation of regulations, or even engaged in illegal business activities and were investigated and dealt with. Printing, reproduction and distribution enterprises should, on the basis of the work of the past few years, further strengthen internal management and raise the level of lawful operation. The relevant work requirements are hereby notified as follows.
- Carry out education and training. Enterprises should, in light of their own operating conditions and the quality of their employees, regularly organize management personnel and frontline employees to study industry regulations and policies and to learn job skills and knowledge. Enterprises should formulate employee education and training plans and earnestly implement them, and take practical measures to support and encourage employees' self-study. Through enterprise training and employee self-study, employees should become familiar with industry regulations and policies, clearly understand the bottom line of resisting illegal printing, reproduction and distribution activities, clearly understand the bottom line of controlling hidden hazards of production accidents, enhance their conscientiousness in lawful operation and safe production, and consciously safeguard cultural security and production safety in production and operation.
Where the legal representative or the principal person in charge of operations of a printing enterprise has not obtained a certificate of qualification from regulations training, or obtained the certificate more than 5 years ago, the enterprise must promptly register for training organized by this Bureau.
This Bureau plans to organize, together with the cultural committees of all districts and counties, a Printing Regulations Study Month for printing enterprises across the city in October 2014. The activity plan will be issued separately. During the Study Month, knowledge competitions on printing industry regulations, safe production and green printing will be held. All printing enterprises should actively organize their own competition activities, mobilize employees to take part in answering questions, and send contestants to participate in the competitions organized by the cultural committee of their district or county and by this Bureau.
- Investigate law-abiding status. Enterprises should, according to their own circumstances, regularly and irregularly investigate possible problems in all links of production and operation activities. The main problems that printing enterprises need to investigate are the implementation of the five systems for printing management, especially the implementation of the system of printing entrustment letters for books and periodicals, the verification of printing permits for publications of an internal nature, and the verification of printing permits for overseas printed materials.
For problems found in the investigation, the enterprises concerned must promptly take effective measures to solve them, improve the relevant systems, correct the illegal state, stop illegal operations, eliminate hidden hazards of accidents, and restore themselves to a state of lawful and standardized operation and safe production.
- Improve enterprise systems. Enterprises should, on the basis of self-inspection, promptly improve their own rules and regulations in accordance with industry laws and regulations. Printing enterprises should, in accordance with the Provisions on the Administration of Printing of Printed Materials, focus on improving their systems for printing verification, printing registration, custody of printed materials, delivery of printed materials, and destruction of defective printed materials from printing activities. Reproduction enterprises should, in accordance with the Measures for the Administration of Reproduction, focus on improving relevant systems such as verification for undertaking reproduction business. Distribution enterprises should, in accordance with the Provisions on the Administration of the Publication Market, focus on improving their systems for purchasing and selling publications and their mechanisms for monitoring publication content. In addition, enterprises should, in light of self-assessment of hidden accident hazards, improve their safe production systems and equipment operating procedures, strengthen the enforcement of systems, and improve the effectiveness of system implementation.
- Strengthen the responsibility mechanism. On the basis of comparative inspection and improvement of enterprise rules and regulations, enterprises should further strengthen the responsibility mechanism for internal management and clarify job duties and accountability rules. For key positions in business processes and production safety control, a strict responsibility mechanism must be implemented. In order to maintain standardized operation and production safety, special personnel should be assigned to ensure the smooth flow of internal management information, so that national industry regulatory policies can be implemented in a timely manner. Printing and reproduction enterprises must conscientiously ensure that printing and reproduction business without lawful entrustment procedures is resolutely refused; and that, where printing entrustment letters for books and periodicals and reproduction entrustment letters have not been issued, or have been issued but not yet filed for the record, machines are resolutely not started for printing and reproduction;
where hidden accident hazards arise in the production process or equipment, production is resolutely stopped; and where fire-fighting facilities become ineffective, they are resolutely corrected. Distribution enterprises must conscientiously ensure that the purchase and sale of all publications have lawful procedures and follow lawful channels; and that, upon discovering any doubt about unclear sources of publications, or illegal or prohibited content in publications, they immediately stop purchasing and selling. Through the implementation of a responsibility system with dedicated posts and personnel, the above requirements should be achieved, putting an end to the printing, reproduction and distribution of illegal publications and reproductions, putting an end to the printing, reproduction and distribution of infringing and pirated publications and reproductions, and putting an end to the occurrence of production safety accidents.
- Conscientiously cooperate with supervision. This Bureau will, together with the cultural committees of districts and counties, conduct regular and irregular inspections of printing, reproduction and distribution enterprises. The inspection results will be included in the enterprises' annual verification. Clues of illegal operations found during inspections will be transferred to the municipal and district cultural law enforcement departments for case filing and investigation. All enterprises should regard cooperation with the supervision and inspection of the press and publication administration departments and cultural law enforcement departments as an important part of enterprise management. As for shortcomings and problems in their lawful operation, standardized operation and safe production, once discovered by the administrative and law enforcement departments, they must immediately set about remedying and solving them.
