Printing Illegal Publications Without a License: Voluntary Surrender Leads to a Suspended Sentence

Published:2021-04-16 · Industry News

Editor's note: Zhang operated a printing factory in the urban area, but in fact he had not obtained a "Printing Business License". However, the defendant's attitude was fairly good, and he requested a lighter punishment. Based on Zhang's criminal circumstances and show of repentance, the court decided to apply a suspended sentence to him and accordingly made the above first-instance judgment.

On August 19, the Tinghu Court of Jiangsu tried a case of illegal business operation and made a first-instance judgment in accordance with the law: for the crime of illegal business operation, the defendant Zhang was sentenced to three years' imprisonment with a four-year suspension, and was fined 50,000 yuan.

Zhang operated a printing factory in the urban area, but in fact he had not obtained a "Printing Business License". In November 2012, Zhang met a man who claimed to be surnamed Li, who asked for cooperation to print some books and periodicals in Zhang's factory. Seeing that there was profit to be made, Zhang agreed. Thus, from the end of 2012 until February 2013, without a license, Zhang illegally printed two kinds of prohibited books and periodicals, totaling 101,500 copies, for "Li" in the printing factory he operated. Later, by chance, Zhang learned that "Li" was in fact only an alias, and that his real name was Hu, and he began to be suspicious of him. In 2013, Hu was arrested by the police. Zhang watched relevant legal education programs on television and found that the books and periodicals he had printed for Hu were all prohibited items. Zhang became frightened, and voluntarily surrendered himself to the public security organ, truthfully confessing the above facts.

During this period, entrusted by the court, the office of the leading group for community correction work of Tinghu District submitted to the court a report on the investigation into the circumstances of the defendant Zhang, and suggested that a non-custodial penalty be applied to the defendant Zhang. Zhang's defender argued that the typesetting throughout the printing process was brought by Hu himself, most of the relevant personnel were arranged by Hu, and the covers of the books and periodicals were also printed by Hu elsewhere, and that the defendant Zhang only printed the middle part, and requested a lighter punishment. Based on Zhang's criminal circumstances and show of repentance, the court decided to apply a suspended sentence to him and accordingly made the above first-instance judgment.
