Opposing the single-use plastics ban: plastics manufacturers sue the Canadian government
Recently, more than twenty plastics manufacturers joined forces to file a lawsuit, asking the Federal Court of Canada to halt the Canadian government's ban on single-use plastic items. These manufacturers formed the "Respo
nsible Plastic Use Coalition" (RPUC). This is the second time the coalition has filed a legal challenge to the government's plan to ban single-use plastic items.
The lawsuit these plastics manufacturers filed in 2021 concerns the definition of whether plastic products are toxic. The Canadian government placed certain plastic products on the list of toxic substances under the Environmental Protection Act. The plaintiffs asked the court to strike down this law.
Canada's Liberal federal government plans to ban the import and production of plastic bags, foam takeout containers, single-use plastic tableware, straws, stir sticks and six-pack rings by the end of this year, ban their sale by the end of next year, and ban their export by the end of 2025. The Responsible Plastic Use Coalition's request in the lawsuit is to cancel this plan, prohibit the government from using Environmental Protection Act provisions to regulate the production and use of single-use plastic items, and temporarily freeze the ban before a final judgment is issued.
Canada's Environment Minister Steven Guilbeault is optimistic that the court's ruling will uphold the ban on single-use plastic items. He also said that rather than meeting in court, he would prefer to cooperate with manufacturers to improve plastic recycling.
