Interim Provisions on Qualification Requirements for Printing Business Operators

Article 1 These Regulations are formulated in accordance with the provisions of the Regulations on the Administration of the Printing Industry and the spirit of the relevant State Council directives on rectifying and standardizing the order of the printing market, with a view to further standardizing the establishment and approval of printing business operators and encouraging such operators to improve their operating qualifications and technical standards.

Article 2 "Printing business operators" as referred to in these Regulations include enterprises engaged in the printing of publications and of packaging and decorative printed matter, enterprises, institutions or individuals engaged in the printing of other printed matter, enterprises or institutions specializing in typesetting, plate-making and binding, and units or individuals engaged in photocopying and printing.

Article 3 In addition to complying with these Regulations, the approval of the qualifications of printing business operators shall also comply with the State's plans for the total volume, structure and layout of the printing industry and with other conditions stipulated by laws and regulations.

Article 4 An enterprise engaged in the printing of publications shall meet the following conditions:

(1) It has a corporate name and articles of association;

(2) It has a defined business scope;

(3) It has fixed production and operating premises suited to its business needs, with a factory building area of not less than 800 square meters;

(4) It has funds sufficient to maintain normal production and operation, with registered capital of not less than RMB 2 million yuan;

(5) It has the necessary equipment for printing publications, including at least 2 automatic folio-size offset printing machines manufactured within the past ten years and not listed in the Catalogue for the Elimination of Backward Production Capacity, Processes and Products;

(6) It has an organizational structure and personnel suited to the needs of its business scope, and its legal representative and the principal persons in charge of production and operation must have obtained the Certificate of Qualification for Training in Printing Regulations issued by the provincial-level administrative department in charge of press and publication;

(7) It has sound operational management and financial systems covering print order verification, registration, safekeeping, delivery and destruction, as well as a sound quality assurance system.

Article 5 An enterprise engaged in the printing of packaging and decorative printed matter shall meet the following conditions:

(1) It has a corporate name and articles of association;

(2) It has a defined business scope;

(3) It has fixed production and operating premises suited to its business needs, with a factory building area of not less than 600 square meters;

(4) It has funds sufficient to maintain normal production and operation, with registered capital of not less than RMB 1.5 million yuan;

(5) It has the necessary equipment for printing packaging and decorative printed matter, including at least 2 offset, gravure, flexographic or screen printing machines and downstream processing equipment manufactured within the past ten years and not listed in the Catalogue for the Elimination of Backward Production Capacity, Processes and Products;

(6) It has an organizational structure and personnel suited to the needs of its business scope, and its legal representative and the principal persons in charge of production and operation must have obtained the Certificate of Qualification for Training in Printing Regulations issued by the administrative department in charge of publication administration of a people's government at or above the prefecture level (hereinafter referred to as the publication administration department);

(7) It has sound operational management and financial systems covering print order verification, registration, safekeeping, delivery and destruction, as well as a sound quality assurance system.

Article 6 An enterprise or institution engaged in the printing of other printed matter shall meet the following conditions:

(1) It has a name and articles of association;

(2) It has a defined business scope;

(3) It has fixed production and operating premises suited to its business needs, with a factory building area of not less than 100 square meters, and the premises are not used for residential purposes;

(4) It has production equipment and funds suited to its business needs, with registered capital of not less than RMB 500,000 yuan;

(5) It has an organizational structure and personnel suited to its business needs, and the legal representative of the enterprise or the person in charge of the institution must have obtained the Certificate of Qualification for Training in Printing Regulations issued by the publication administration department at or above the county level;

(6) It has sound operational management and financial systems covering print order verification, registration, safekeeping, delivery and destruction, as well as a sound quality assurance system.

Article 7 An enterprise or institution engaged in specialized typesetting, plate-making and binding shall meet the following conditions:

(1) It has a name and articles of association;

(2) It has a defined business scope;

(3) It has fixed production and operating premises suited to its business needs, with a factory building area of not less than 300 square meters;

(4) It has funds sufficient to maintain normal production and operation, with registered capital of not less than RMB 800,000 yuan;

(5) It has the necessary typesetting, plate-making and binding equipment, including at least 2 pre-press or post-press processing machines manufactured within the past ten years and not listed in the Catalogue for the Elimination of Backward Production Capacity, Processes and Products;

(6) It has an organizational structure and personnel suited to the needs of its business scope, and the legal representative of the enterprise and the principal persons in charge of production and operation, as well as the person in charge of the institution, must have obtained the Certificate of Qualification for Training in Printing Regulations issued by the publication administration department at or above the prefecture level;

(7) Having sound business management and financial management systems and a quality assurance system covering the verification, registration, custody, delivery, and destruction of printing jobs.

Article 8 A unit engaging in photocopying and printing business shall meet the following conditions:

(1) Having a unit name and articles of association;

(2) Having a defined scope of business;

(3) Having fixed production and business premises suited to business needs, with a floor area of not less than 15 square meters, and not located in premises used for residential purposes;

(4) Having registered capital or funds of not less than 100,000 yuan RMB;

(5) Having the necessary photocopiers, computers, printers, business card printing machines and other equipment (light printing equipment of octavo size or above shall not be allowed);

(6) Having an organizational structure and personnel suited to the scope of business; the person in charge of the unit must have obtained a Printing Regulations Training Certificate issued by the publication administration department at or above the county level;

(7) Having sound business management systems for the verification, registration, custody, delivery, and destruction of printing jobs.

Article 9 Individuals engaging in the printing of other printed matter or in photocopying and printing business activities shall comply with the provisions of Article 6 and Article 8 of these Regulations.

Article 10 Where a printing operator engages in other types of printing business activities, it shall also meet the qualification conditions for establishing such a printing enterprise or unit.

Article 11 The publication administration department must examine and approve the qualifications of printing operators in accordance with these Regulations; where the conditions stipulated in these Regulations are not met, establishment shall not be approved.

Article 12 In the annual verification of printing operators, in addition to the conditions stipulated in these Regulations, printing operators shall also be required to have no record of violating printing administration regulations.

Article 13 Where printing operators established before these Regulations came into effect fail to meet the conditions stipulated in these Regulations before March 1, 2002, the renewal of their Printing Business License shall be temporarily withheld.

Article 14 These Regulations shall come into force as of the date of promulgation.
