Printing Plant Cadre Sentenced to 10 Years and 6 Months for Embezzling 130,000 Yuan in Workers' Dormitory Demolition
Hong, a member of the liquidation team remaining on duty at a state-owned printing plant in Jiaxing, took advantage of his position to embezzle more than 130,000 yuan of state-owned property by fabricating dormitory unit numbers during the demolition and relocation of the plant's employee dormitories. On October 23, the Nanhu District People's Court of Jiaxing sentenced Hong to ten years and six months in prison for embezzlement.
Hong, 59, was formerly a cadre in the storage and transportation section of a state-owned printing plant in Jiaxing.
After the printing plant went bankrupt and entered liquidation in 1998, the employee dormitories, which were state-owned assets, were placed under the trusteeship of Jiashi Group.
In 2007, the printing plant's employee dormitories were demolished. Entrusted by the property department of Jiashi Group, Hong, as a member of the printing plant's liquidation team remaining on duty, began handling housing reform and demolition and resettlement work for the employee dormitories.
While processing the division of property rights, Hong happened to discover that the area recorded on the property ownership certificate was 15.6 square meters more than the actual total area after division.
Hong therefore created a fictitious dormitory unit number for the extra 15.6 square meters and, in his nephew's name, purchased the property rights from the printing plant's liquidation team for 4,180 yuan.
Afterwards, Hong transferred the property rights to his mistress, Wang, so that she could take part in the demolition and resettlement, and collected more than 7,100 yuan in subsidies including the early relocation incentive payment.
In August 2007, after paying more than 5,700 yuan in price differences, Wang successfully obtained a two-bedroom apartment in Yinliu Fang, Sanshuiwan, and sold it to someone else a month later for more than 130,000 yuan.
The court held that the defendant Hong, by taking advantage of his position in managing state-owned property entrusted to him by the state-owned enterprise, illegally embezzled state-owned property worth 134,987.6 yuan, and that his conduct constituted the crime of embezzlement. After being brought to justice, the defendant Hong truthfully confessed to the facts of the crime and was given a lighter punishment in accordance with the law. He was therefore sentenced to ten years and six months in prison for embezzlement, along with confiscation of 30,000 yuan of his property.
