Interpretation of the Notice on Standardizing the Management of Packaging and Trademark Use for "Huoshan Huangya
[ppzhan Abstract] In response to problems on the market such as non-standard tea packaging labels and forged or fraudulently used marks, the Huoshan County Administration for Industry and Commerce strengthened market research, held a meeting together with the county tea office to study the matter specifically, and recently issued the 'Announcement on Standardizing the Management of the Packaging and Trademark Use of Huoshan Huangya', and jointly strengthened market supervision to maintain order in the tea market.
First, standardize packaging management. The Announcement requires that tea production enterprises must obtain a production license, use dedicated packaging, and print the QS mark and its number on their packaging labels. Packaging labels shall comply with the relevant provisions of the 'Food Safety Law'. Prepackaged food packaging shall bear a label stating the product name, specification, net content, production date, shelf life, storage conditions, and the operator's name, address, contact information, product standard code, production license mark and number, etc. Operators using the general 'Huoshan Huangya' packaging must make their own labels, print them as cards, with label content conforming to legal provisions, and affix them at the reserved blank label position on the general packaging. For all dedicated and general packaging, if labels conforming to laws and regulations are not printed or affixed, they shall be treated as 'three-no' food packaging, and law enforcement departments will investigate and deal with them in accordance with the law.
Third, standardize packaging printing management. All units or individuals shall, before printing 'Huoshan Huangya' packaging, submit the design draft to the county tea association for review and filing, and all enterprises undertaking the printing of 'Huoshan Huangya' packaging must have a lawful printing license and file with the association. Otherwise, their trademark use license and printing qualification will be cancelled.
Fourth, strengthen supervision and law enforcement. The county's industry and commerce, quality supervision and tea departments will draw personnel and organize management and law enforcement forces to carry out joint law enforcement, strengthen tea market management around the clock, and accept and handle public complaints and reports. Those who use various packaging labels in a non-standard way or deal in 'three-no' prepackaged products will be investigated, dealt with and banned in accordance with the law. All kinds of trademark infringement and counterfeit and shoddy practices, such as adulteration and passing off inferior goods as superior, will be resolutely cracked down on and investigated and dealt with by filing cases in accordance with the law.
