Food Factory Defaults on Payment; After a Six-Year Wait, Carton Maker Finally Gets Its Money Back
"I never expected this money could really be recovered." Recently, the Laifeng Court of Enshi Prefecture concluded the enforcement of a sales contract dispute case. The applicant presented a banner printed with "Fairness and Justice, A Good Judge of the People" to the Laifeng Court to express its gratitude to the court.
The applicant, a printing and packaging company in Laifeng, is engaged in the processing and sale of paper packaging boxes.
Starting in February 2016, the company supplied birthday cake packaging boxes to a food business in Tongren City, with payment upon delivery and acceptance, but the food business never settled the payment. The printing and packaging company sued it in court, and the court ruled that the food business should pay the company more than RMB 30,000 for the goods. But after the judgment took effect, the food business did not fulfill its payment obligation, so the company applied to the court for compulsory enforcement.
During enforcement, the enforcement judge ascertained that the food business had, without fulfilling the obligations determined by the effective legal document, completed deregistration with the industry and commerce authorities and could not be contacted. The enforcement judge therefore immediately set out for Tongren City to look for clues related to the operator of the food business, and with the cooperation of several departments finally found the operator, Mr. Li. The enforcement judge immediately rushed back to Laifeng County and lawfully issued a ruling adding Mr. Li as the person subject to enforcement, froze the bank accounts under his name, and at the same time proactively communicated with Mr. Li to persuade him to fulfill his legal obligations. In the end, Mr. Li repaid more than RMB 30,000 for the goods, and the case was successfully concluded.
